Terms and Conditions

Overview

This website is operated by Katherine Cadin of La Fougeraie, La Route de la Cote, St Martin, Jersey and any reference to “I”, “me”, “we”, “us” and “our” is to Katherine Cadin.  These terms and conditions comply with the obligations required under Article 5 of the Distance Selling (Jersey) Law 2017.

Please read these Terms and Conditions carefully before accessing or using my website, or placing an order with me. By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or place an order with me.

About you

To place an order with me, you need to be at least 16 years old, have access to a payment method approved by Paypal and be authorised to use that payment method.

Placing an order

By placing an order with me, you are offering to purchase a product from me, subject to these Terms and Conditions. All orders are subject to availability and confirmation by me.  I reserve the right to refuse any order and I may limit or cancel quantities purchased.

I only accept your order once payment has been approved. Please read and check your order carefully before submitting it. If you need to correct any errors you can do so before submitting your order.

Price and product description

The price payable by you will be the price of the goods as set out on my website at the time of acceptance of your order, together with all relevant postage and taxes. Payment will be taken by credit/debit card through my payment service provider, Paypal.

Whilst I try to ensure that all details, descriptions and prices of products are accurate, errors may occur. I reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. If I discover an error in the details, descriptions and/or prices of any product that you have ordered, I will inform you as soon as possible using the contact information you have supplied.

I may give you the option of reconfirming your order (with the updated information) or I may cancel the order, at my sole discretion. If the order is cancelled and you have already paid for the product(s), you will receive a full refund.

Payment

Payment is made via Paypal. 

When placing an order, you undertake that all details you provide are true and accurate, that you are authorised to use the payment method used to place your order, and that there are sufficient funds to cover the cost of the order. If your delivery address is outside Jersey you may be required to pay import duties and other taxes or levies when your order reaches your destination country. These and any additional charges for customs clearance are your responsibility

Returns and refunds

I offer a simple returns policy.  This policy doesn’t affect your statutory rights.

Intellectual property, software and content

I own or have permission to use the intellectual property rights on the website. These rights are protected around the world. All such rights are reserved.  You are not allowed to use any part of the website for commercial purposes unless you have my express permission.

Privacy policy

Any personal information that you provide to me will be dealt with in line with my Privacy Policy.

Use of website

I do not guarantee, represent or warrant that your use of the website will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the website is at your sole risk.

Liability and indemnity

To the maximum extent permitted by law, I shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the website or any products purchased from me, or for any other claim related in any way to your use of the website or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the website or any content (or product) posted, transmitted, or otherwise made available via the website, even if advised of their possibility.

You agree to indemnify, defend and hold me harmless from any claim or demand, including costs, made by any third party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Change to these terms and conditions

I reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to the website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Dispute resolution

These terms and our dealings with you are subject to Jersey law and the exclusive jurisdiction of the Jersey courts.

Delivery and Returns

Delivery

I use Jersey Post to deliver my products and aim to dispatch within 4 days of receipt of an order but I cannot guarantee dispatch or delivery.

Local deliveries in Jersey will be charged at £3.50 flat rate, or you have the option for FREE collection from my studio.  Collection times are to be agreed by customers by e mail communication with myself at kcadinart@icloud.com prior to collection.

Delivery of the goods will occur when I deliver them to the address you provide me with when you made your order. You are responsible for the goods once delivery has taken place.

I do not take any responsibility for lost or failed orders occurring as a result of you providing incorrect delivery information.

I don’t deliver outside Jersey yet, but when I do, you may be required to pay import duties and other taxes or levies when your order reaches your destination country. These and any additional charges for customs clearance are your responsibility

Returns

I hope you are happy with your purchases but if for any reason you are not, I can offer an exchange or refund on any item (with the exception of cards) as long as it is returned to me in its original packaging and in a saleable condition within 14 days of receipt.

When you return or exchange any product (unless it is damaged or faulty), you must cover the shipping charges. Please note that you will not be reimbursed for the original shipping charges.

Before returning any goods, please contact me within 7 working days by email to kcadinart@icloud.com.  The returns address is Katherine Cadin, La Fougeraie, La Route de la Cote, St  Martin, Jersey JE3 6DY.

Refunds will only be made on receipt by me of the returned item and then as a credit to your payment card, processed via Paypal. Please note it can take 4 working days for any refunds processed to appear on your card statement.
